Service

By accessing or using opendays.co.za ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform. These Terms apply to all visitors, learners and institution users of the Platform. Use of the Platform constitutes acceptance of these Terms, together with our Privacy Policy, which is incorporated by reference.

opendays.co.za provides an online marketplace that:

• Lists open day events hosted by tertiary institutions across South Africa
• Allows learners to browse, filter, save and set reminders for open days
• Facilitates WhatsApp connections between learners and institutions
• Hosts virtual open day sessions and live Q&A
• Provides institutions with QR code tracking and analytics tools
• Offers a pro learner tier and paid institution subscription plans

The Platform is provided "as is" and we reserve the right to modify, suspend or discontinue any feature at any time with reasonable notice.

• You must provide accurate, current and complete information during registration
• You are responsible for maintaining the confidentiality of your password
• You must notify us immediately if you suspect unauthorised access to your account
• You may not share your account credentials with any other person
• Each person or institution may hold only one active account
• We reserve the right to suspend or terminate accounts that violate these Terms

You may not use opendays.co.za to:

• Scrape, harvest or extract data from the Platform without written permission
• Send unsolicited marketing messages (spam) to learners or institutions
• Post false, misleading or fraudulent institution or event information
• Impersonate any person, institution or organisation
• Attempt to gain unauthorised access to any account or system component
• Use the Platform for any purpose that violates South African law
• Transmit malware, viruses or any other malicious code
• Circumvent any security or access control measure on the Platform

Violation of these prohibitions may result in immediate account suspension, legal action, or both.

Our Platform facilitates direct WhatsApp connections between learners and institutions. Please note:

• opendays.co.za is not responsible for the content of WhatsApp messages sent by institutions
• Institutions are solely responsible for compliance with WASPA and ECT Act requirements
• Learners consent to being contacted by institutions whose events they interact with
• You can withdraw WhatsApp consent at any time in your profile settings
• We do not store the content of WhatsApp messages exchanged outside the Platform

All content on opendays.co.za, including but not limited to the logo, design, copy, software and platform architecture, is owned by or licensed to OpenDays (Pty) Ltd and is protected by South African copyright law. You may not copy, reproduce, distribute or create derivative works from any Platform content without our prior written consent. Institution users retain ownership of the content (event listings, descriptions, images) they submit to the Platform but grant opendays.co.za a non-exclusive licence to display and distribute that content through the Platform.

To the maximum extent permitted by South African law:

• opendays.co.za provides the Platform on an "as is" basis without warranties of any kind
• We do not guarantee the accuracy of institution listings or event information
• We are not liable for any loss or damage arising from your use of the Platform
• We are not responsible for the conduct of institutions or learners on or off the Platform
• Our total liability in any matter shall not exceed the amount you paid to us in the 12 months preceding the claim

You may delete your account at any time from your profile settings. We may suspend or terminate your account if you: • Breach any of these Terms of Service • Engage in conduct we determine to be harmful to the Platform, learners or institutions • Fail to pay outstanding subscription fees (institutions) • Are found to have provided false information during registration Upon termination, your data will be handled as described in our Privacy Policy.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall first be referred to mediation. If mediation fails, disputes shall be resolved in the Magistrates' Court or High Court of South Africa, depending on the value of the claim. If you have a complaint about our service, please contact us at hello@opendays.co.za before initiating any legal proceedings.

We may update these Terms at any time. When we make material changes, we will notify registered users via email at least 30 days before the changes take effect. Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the new Terms. If you do not agree, you must stop using the Platform and delete your account.
